His lawyer is Martin Lewis iirc so i wouldn't completely rule it out but any normal one would tell him to drop it.

McNicol might have a case wrt data breaches but, again, i can't see him wanting to take a libel action through the courts. The challenge for Labour is that they've already made it clear that they don't want to fight any action in court either, so it's like waving a big sign saying 'come get your settlement payment here'.
