Facebook's latest decision on how to handle repeatedly being reprimanded and sued for violating election law in Washington: accept and run multiple ads from some candidates and reject all ads from other candidates. Seems untroublesome for sure.

xxp their response to being criticised for their lack of privacy policies is to ruin tons of bus shelter ad spaces with their weird propaganda type ads about how great they were. Those bus shelter spaces would literally be better off if used for abusive graffiti and ads for hair plugs.

In response, the companies have made an interesting argument: Because they say they ban local political ads in Washington state, when they end up selling such ads they don't have to make disclosures about them—because, after all, they say they ban them.

Facebook and Google also claim that federal law makes them immune from Washington state's efforts to regulate its own elections.

The still-unfolding PDC investigations of Facebook and Google should help reveal whether the agency has been persuaded by the tech giants' attempts to position themselves as beyond the reach of Washington state law.

In the meantime, the local Facebook ads scroll on.

Election advertising in Washington still illegal and also still "banned" by internal Google policy. In February, they served six million two hundred thousand election ads to a targeted 37% of the population of Spokane (over-45s), for a $4,665 outlay by one lobbying group. As in all cases over the last few years, they are refusing to disclose required information to either private requests or government regulators.

^^ Charged with unknown number of multiple violations. The top fine is only $10,000 - last time the AG sued them, they just paid $238k in fuck-off money, and this time are saying that the law still doesn't apply to them because people can engage with a special analytical system on the ads so that Facebook will get more information about which are most effective, and use that to sell more illegal election ads with better targeting use the Facebook Ad Library Tool to find out... something or other
