He’s also using an ADHD diagnosis to gain sympathy with the judge, claiming the symptoms he suffers on a daily basis are very taxing.

McFarland says he has no criminal record, has cooperated with the Feds since the beginning and even plead guilty to the charges. He had numerous family members and friends write letters, along with Leslie’s, to the judge in support of him

McFarland is proposing 6 months of home confinement or a “minimal” period of incarceration, 1,000 hours community service and three years probation. He’s also already agreed to pay back 26 million in restitution.

According to a court filing, McFarland set up a “sham ticket-selling business for exclusive events through a company controlled and operated by McFarland (”NYC VIP Access”).”

The filing alleges that McFarland “perpetrated a scheme to defraud attendees of the Fyre Festival and others by soliciting them to purchase tickets from NYC VIP Access to exclusive events when, in fact, no such tickets existed.”

McFarland allegedly engaged in a scheme to sell fake tickets to concerts and sporting events, including events like the Met Gala and Burning Man.

And despite the criminal charges and the flameout of his last two businesses — Fyre Media and the concierge service Magnises, which offered its members VIP experiences — people showed up to entertain his pitch, a scheme to make money off Instagram live streams.
