i like basketball but there's too many games. idk why that is such a barrier for me but i can't get invested in individual games when i try and can't get past just being a playoff watcher. also, the learning curve is steep, i already knew about football since a kid but i knew nothing at all about basketball prior to rocking up here.

ok i cannot resist b/c this is the first time i saw these...here are two footnotes from the wells report:

Footnote 11 page 35
The guidelines stated that: “Prior to each game, a team‟s equipment manager will prepare 12 footballs to be used for non-kicking downs. The footballs will have the prior approval of the team‟s quarterback, who can briefly test them the preceding week, but the balls cannot be used during midweek or pregame practice sessions. These footballs will be delivered to the officials‟ locker room two hours and 15 minutes prior to game time. The Referee will insure that they are properly inflated and give final approval for their use. Game balls approved for a previous game can be submitted, provided they meet the standards of a new ball. The home team will prepare another 12 balls in the event of inclement weather or other reasons.” Under the current guidelines, a referee also may reject footballs in the course of a game if he determines that they are in “unsatisfactory condition.”

During our investigation, we also obtained information concerning the football preparation process used by the Colts. Colts personnel informed us that, like the Patriots, they take new footballs and rub them with a wet or warm towel to remove the outer preservative, followed by brushing with the same brushes provided by Wilson. Footballs are then used during practice, with the expectation that normal wear and tear on the footballs, and their interaction with players‟ sweat, will help break in the balls. Sean Sullivan, the Colts Equipment Manager, explained that, in his view, the best way to soften the leather is for the footballs to interact with sweat during practice and then get baked in the sun. The Colts repeat the brushing and baking process, and continue to practice with the footballs as they are broken in, until they reach a certain point, when they will be set aside for potential game use. The footballs will be inflated to a pressure between 12.9 and 13.05 psi prior to being inspected by Colts quarterback Andrew Luck, who typically selects his game balls two days before each game. The designated balls are placed into ball bags and kept locked in the Colts equipment room until their pressure is checked again shortly before being delivered to the game officials.

I think it's entirely possible that Brady was involved. I don't think the Wells Report proved it whatsoever (he "probably" did it, not good enough). as much as it benefits my Fins to have him out four games, as a fan of the game, it gives me a bad taste for this arbitrary punishment for something so silly (that they didn't even prove).

The article fails to mention what those "number of ways" would be, but rather mentions a number of places the data might be stored, which is different, because the NFL is not a law enforcement agency and has no subpoena power. So I'm not sure whether they would have any legal means to acquire such data, even though it would undoubtedly still be stored somewhere.

Which the article doesn't actually establish. If the phone, with data, had been surrendered for inspection, the data would certainly have been placed in the NFL's possession. The bare fact that the data still exists doesn't prove the NFL could access it now by any means in their power.

Brady can reasonably say that he is not in possession of the data. He doesn't control the servers where it would now be stored. Anyway, the NFL decided it had enough evidence to draw a conclusion without the phone data.

Now, if Brady were to sue in court over the suspension, perhaps the NFL could pursue the phone data through discovery. So far, Brady has only pursued his appeal under the collective bargaining agreement, as far as I know.

some good quotes here. judge seems to believe it is likely that deflation occurred (no mention of allowed range tho) and that brady was at least aware of it. skeptical of anything more than that, in particular that the nfl has any actual evidence of brady's involvement or of any 'conspiracy'. nfl response shows they have literally nothing: we think deflation occurred, brady is qb, QED.

I think its more accurate to say that the nfl has circumstantial evidence, but no direct evidence. Given what has been established as fact, one may deduce a limited number of scenarios that fit those facts. A few of those scenarios exculpate Brady, but most would not.

This kind of reasoning would not be sufficient in a criminal trial, but the NFL isn't putting Brady in prison, either. afaics, they are claiming only that a preponderance of the evidence supports their conclusion and that's good enough.

The only real question here is whether the league's actions are allowed under the collective bargaining agreement. If they are allowed, then the 4-game suspension sticks. If not, then he plays.
