it's been torn apart as shitty reporting in several places -- the actual suit only addresses the fact that people were activating siri on accident, either via button press or saying something that sounded similar to the prompt, and audio that followed was sent to apple's servers as a query

the PR about the lawsuit seems to be pushing that. the ars technica article has since been edited to add this after the Reuters ref: (claims which remain disputed)

the servers that handle siri requests are known -- people obviously have tried reverse engineering the API, etc. over time. if apple devices were randomly sending arbitrary audio clips to the cloud, people would know because someone would have documented this, at length! they're one of the most scrutinized tech platforms in the world, now.

I used to occasionally activate it on my watch when the knob would get hung up on my shirt cuff, and it's obvious when you do that -- it vibrates and starts talking. I mean, it could somehow pick it up in your pocket and you're in a loud area and don't hear it talking in response, but it still seems unlikely to me

can you IMAGINE getting ads for Air Jordans or the Olive Garden, meaning you're probably either someone who shops for shoes online or lives in the proximity of an Olive Garden?

Apple's shadiness is mostly about business dealings, lock-in, and doing a less than optimal job of vetting crap in their supposedly well-vetted app store

their actual user data privacy, and the boundary around it, is pretty rock solid. there are exceptions where it seems like they weaseled out of paying specific security bounties, but if they say there's absolutely no way for ads to feed off of siri, I believe it until I see very specific evidence

they don't even sell ads outside of their own app stores, iirc, so I have no idea what the mechanism would be. they'd have to be selling the data to a third-party ad network like google's
