So based on my detective work so far, I think it's Isle of Wight '69 (but I'm not 100% sure), and I think it's not the Who. My best guess as to acts from the '69 Isle of Wight is that it's Free, but there are a ton of bands on the lineup I wouldn't be able to ID on sight and that there aren't a lot of good photos of on GIS.

now that I look at it, that is kind of a weird kit set up. You think the second bass drum is not visible/on the right, with the snare in the middle?

It looks like the drummer may be playing with no front head on his kick, if that helps at all. Although I'm not even sure of that from the picture. Unusual move on a giant festival stage.

He also seems to have some kind of contraption that keeps his hi-hat stand in place by anchoring it to the kick, never seen one of those before.

this is true but finding shots from behind the kit/looking out from the stage seems kinda hard with GIS - you google a lot of these festivals and all you get is shots from the crowd and handbills

Right, I think I've got it. First of all, from the crash barriers and distinctive monitors at the front of the stage I worked out it's the Bath Festival, 27-29 June, 1970. Here's Canned Heat:

Apparently it was a Jerry Goodman (of Mahavishnu Orchestra) outfit. I had never heard of them before although I certainly know who he is. Want to check them out now.

I only know who the Flock was because WXRT in Chicago used to talk about them like they were some incredible great lost '60s band a la Moby Grape. Didn't actually hear any of their music until today, and it sounds exactly like you'd imagine the Mahavishnu violinist fronting Blood, Sweat & Tears to sound like.

I don't know what UK copyright/persona law was like in 1970, but it also kind of makes sense that they'd use an anonymous photo of a lesser-known band if there was otherwise a risk of paying for use of someone's likeness in an ad.
