Nah i looked it up i don't think the foia thing really matters, the Public Record thing applies to stuff like 911 calls and there isn't a record of a phone call 99% of the time. so Real Journalist Steve Rilly is right that *if* there's a record u can foia it but that *if* almost never happens. the journalist pressing interviewee to slip thing doesn't really matter to foia cuz why would you foia a convo between a journalist and a politician the journo can just transcribe it and publish it
the awesomely stupid thing about this take is like, ok, so granted there's this asymmetry of transparency depending what form of communication politicians... and u want to reduce transparency on the one we do have?

When you're talking about Senate-confirmed appointments (especially Cabinet positions) phone calls with non-federal parties are frequently transcribed, if not at least partially scripted or even advertised on the federal register. When you're talking about other appointed positions, much less than managerial or staff functions below and around them, yeah, phone calls are pretty much all non-record, except if you're talking to a reporter, because DC and Virginia are one-party consent states for recording - Maryland is all party consent but I dunno how that works across jurisdictions.
All this seems like a complete DUH to any journalist working in this town or covering politics generally - I'm not even in public affairs and I know this shit. But Yglesias, as pointed out, is "just a blogger"

Same with the infamous Bangladesh piece. Speak to anyone with even the vaguest knowledge of the country's manufacturing industry and they will tell you that international pressure has forced importing companies to get more serious about safety in factories, that safety standards are notionally being improved by the government and that one of the major problems was factory owners flouting the existing standards that were in place. But nobody with even the vaguest knowledge of manufacturing in Bangladesh was involved in the piece.
