Miller Brewing forklift driver fired after photographed sipping a Bud
RACINE, Wis. (AP) — Just sipping a brewski gave Isac Aguero a career hangover.
Aguero, 24, said he was fired from his job with a Miller Brewing distributor, the same day a picture appeared in The Journal Times of Racine of him drinking a Bud Light, which is brewed by rival Anheuser-Busch Co.
The photo, taken Feb. 5, was part of the newspaper’s weekly “On the Town” feature, which depicts the city’s night life.
Aguero, who had been a forklift operator at CJW Inc. for four years, told the newspaper he was informed by co-workers when he arrived at work last week that he was in trouble because of the picture.
He said he was called into the general manager’s office and told he was fired. Aguero said he was not given a reason and claimed he never had problems with his bosses.
“It was a Saturday and I wasn’t at work,” he told The Journal Times. “They can’t tell me what beverages I can drink. Bud Light’s my beer of choice, I always drink that. Just because I work there, do I have to change what I drink?”
Thomas Bey, a CJW sales manager, read a statement to the Associated Press on Friday and would not answer any questions. He said the company does not publicly discuss past or present employees.
“We consistently remind our employees that drinking alcohol is entirely a personal decision,” Bey said. “The image and reputation of any company is determined in large part by the way its employees are seen to behave. Our employees can and should be our best ambassadors.”

So if Howard Stern was photographed wearing an XM-radio t-shirt, Sirrus would have no grounds to take action against their employee?

I know, I know, Stern's a public figure. I'm not saying that Miller was right to fire the employee, but maybe they did have the right to fire him. I doubt that what they did is illegal.

That woman in Alabama was fired last year for having a Kerry/Edwards sticker on her car. These are scary times.

Does he have any recourse towards the paper for this? I know in some places taking pictures in bars and casinos is prohibited to protect the privacy of the patrons, mainly.

Yeah, I think the issue here is whether he was drinking the Bud Light as a representative of Miller Brewing Company. Which he clearly wasn't: he was doing so as a private citizen, and anyone who picked up the newspaper would have no clue who he actually worked for, so there couldn't possibly be any damage done to the company.

Unless he signed some sort of "product loyalty" contract I don't see this as being a reasonable excuse for firing someone. But.. uh.. I'm remembering a thread we had a while back about a woman being fired for having a Kerry/Edwards bumper sticker on her car and apparently there was nothing she could do about it - so who knows.

I thin kthey are within their rights to fire him. If nothing else, it amounts to implicit promotion of a competitor's product. It doesn't matter that anyone knows who he works for. If Miller could also fire other Bud drinkers who don't work for Miller, they would.

Bud Light drinker may take legal action aginst CJW

RACINE - Isac Aguero would rather fight than switch.

Aguero was fired Monday, the same day a picture appeared in The Journal Times showing him holding a bottle of Bud Light. He worked for CJW Inc., the area's supplier of Miller Brewing Co. products.

On Friday, Aguero, 24, met with reporters throughout the day at his apartment, which he recently moved into. A neon Bud Light sign glowed on one of the walls of an otherwise sparsely furnished room.

Aguero says he's not going to stop drinking Bud and he's trying to hire a lawyer to build a case against his former employer.


"I called a couple of people and I'm waiting to hear from them," he said. "Bud Light is my drink of choice and I'm not going to change."

The story begins on Saturday night when Aguero was out in Downtown Racine during the Mardi Crawl event. His picture appeared in The Journal Times' weekly On the Town feature on Monday.

Attorney Nola Cross of Milwaukee thinks Aguero might have grounds for legal recourse. While Wisconsin is an "at-will" work state - meaning people can be fired at a employer's discretion, as long as it's not for discrimination - another state law may be on Aguero's side.

"In Wisconsin, employees are protected from discharge or other adverse employment action based upon the `use or nonuse of lawful products off the employer's premises during nonworking hours,' " she said.

There are some exceptions in state law, said Cross, a labor attorney in Milwaukee for 30 years, such as situations where the employer is a nonprofit corporation whose mission is to discourage the product's use, such as the American Cancer Association and an employee who smokes. Another exception is when the product impairs the employee's ability to work, such as coming to work drunk, she said.

"In Wisconsin, all of us of age are free to drink or abstain from drinking Bud Light or Miller, or anything else that is legal," Cross said. "The concept is that, while most employment is `at-will' employment, Wisconsin employers do not own their employees like feudal serfs - at least not while they are off work time and outside the employer's

premises."

Aguero said he learned there was a problem with the photo shortly after he showed up to work on Monday. Co-workers told him he was in trouble for the picture. He was then called into the general manager's office and was told he was fired.

Aguero said he was not given a reason for the dismissal, and claimed he never had problems with his bosses at work. He had worked at CJW for about four years before he was fired - and had drank Bud Light even longer than that, he said.

The whole notion that Microsoft is "frowning" at the fact that the workers there own iPods is hilarious. Almost everyone on the bus over to Redmond has them. I don't use the little white headphones, because they're uncomfortable and don't sound as good -- so maybe I'm unintentionally conspicuous, but I never had to hide my iPod when I was working there. As long as I did the work I needed to (which sometimes required I get into iPod zone out), that's the bottom line, and it wasn't a concern. It's counter-productive to be a bit fascist about it.. and I've never heard of anybody at MS getting fired over using an iPod.

My brother used to work at Unilever and during his tenure there, everything in his house that could be Unilever was. At Christmas, all of our gifts from him were Unilever. Nothing conveys the spirit of Christmas more than this box of liquid soap! He came to my apartment one time, went into the bathroom cabinet and said, "what is this? It's not Unilever! You're disloyal!" Honestly, during his tenure there, he was as bad as Amway.

Some of these places are like those South Korean companies where you eat, sleep and exercise the company. Americans like to think they're better, but they're not.
