The House still has the capacity and the authority to investigate the Capitol insurrection, including subpoena power. Pelosi has indicated that if the bipartisan commission was scotched by the Republicans, she'd be open to passing that task on to a House committee, under full Democratic control. The main problem there is that it will eat up time and energy that could be used on other legislation, but if the Senate is going to filibister to death every bill out of the House that becomes a non-issue.

as josh marshall often points out, under the current setup the minority party doesn't even have to show up or exert any effort in order to filibuster. the final vote was 54-35 - they didn't even have to put up 40 votes today!

in fact, these days they barely even have to say they'll filibuster in the first place! it's just assumed that they will.
