I dunno, Judge Kaplan, putting oneself in a position where Donald Trump might (and most likely will) defame you is starting to seem like a pretty sweet deal.

Can a judge sue for defamation?

Josh in Chicago, Friday, 26 January 2024 21:56 (two years ago)

He rails against deep state RINOs, which is exactly what I am - I plan to sue as well

Andy the Grasshopper, Friday, 26 January 2024 21:59 (two years ago)

in fairness (?????????) to the rudy verdict there were two plaintiffs

Its big ball chunky time (Jimmy The Mod Awaits The Return Of His Beloved), Friday, 26 January 2024 21:59 (two years ago)

difference being that Trump is far more likely to actually have that kind of money

Or more likely he hung himself on his own rope there. Someone asked Ken White/Popehat about the possibility of an appeal and reduction on the punitive damages and his understated snark response:

Low. That’s a reasonable multiplier of actual to punitive and consistent with his stated wealth.

The kicker is 'stated wealth' because Carroll's legal team played a clip of a formal deposition where he claimed he was worth $10 billion. So if he suddenly pleads poverty as a reduce to reduce, people get to go 'wow so about this perjury you committed' and then things get even more fun for him. (Trump's team very much saw this possibility coming and tried to work against it today, to no avail.)

Ned Raggett, Friday, 26 January 2024 22:02 (two years ago)

REASON to reduce, etc.

Ned Raggett, Friday, 26 January 2024 22:02 (two years ago)

All I know is he should double the pay of this legal team and bring them in for every single trial. If not to actually defend him then at least to entertain us all. But they should probably defend him, too.

Josh in Chicago, Friday, 26 January 2024 22:06 (two years ago)

he's probably not going to pay his lawyer bills since they lost

Andy the Grasshopper, Friday, 26 January 2024 22:10 (two years ago)

I hope they got yuge retainers up front.

immodesty blaise (jimbeaux), Friday, 26 January 2024 22:11 (two years ago)

Actually, I don't. Any lawyer who represents Trump gets whatever s/he deserves, which is nothing good.

Josh in Chicago, Friday, 26 January 2024 22:15 (two years ago)

So has he posted to Truth Social yet?

Not one direct mention of Carroll or his usual denials. I suspect he/whoever runs the account has clocked -- for now, let's see how long that lasts -- that if he goes down that road again she and her team can easily go 'hey, another defamation trial? don't mind if we do' and then he has to deal with two verdicts already assessed.

Ned Raggett, Friday, 26 January 2024 22:43 (two years ago)

Even good ol' Andy McCarthy on Fox knows this much per WaPo:

Today’s ruling may not be the end of the story, according to Andy McCarthy, a former assistant U.S. attorney in the Southern District.

“In theory, if (Donald Trump) continues to repeat what he said, she can continue to sue him, and seek more millions (in) damages,” McCarthy said on Fox News.

Ned Raggett, Friday, 26 January 2024 22:44 (two years ago)

Couple of separate posts on Bsky to further illustrate the current fun for him:

Surety bonds on appeal in the 2nd Circuit are at the district court's discretion. I'm guessing Judge Kaplan will require a bond for 100% of the verdict. Justice Engoron is likely to issue a ~$400 million fine next week; in state court appeal bonds MUST be for 100% plus statutory 9% interest.

Appeal bonds are generally 100% collateralized; it's conceivable some bank could offer Trump an irrevocable letter of credit, but a half- billion dollars is a lot.

Gonna be a long weekend for somebody.

alpine static, Friday, 26 January 2024 22:56 (two years ago)

Someone else said on Bluesky

He can appeal without putting up the $83M

BUT

If he does not put up the $, Carroll can begin executing the $83m judgment 30 days from now in all fifty states, seizing his cash & personal property and placing liens on his real estate.

Andy the Grasshopper, Friday, 26 January 2024 23:02 (two years ago)

Unperson's last quote there is from Mitchell Epner, solid guy in my experience and great legal commentator (and a lawyer himself etc), and he also posted this:

Right now, FPOTUS is likely in a rage towards his former attorney Joe Tacopina, who made the wise decision to keep Trump off the stand in the 1st Carroll v. Trump trial. Trump appears to have convinced himself that he would have won that case, if he testified and collateral estoppel is unfair.

Get ready for the rants!

“Absolutely ridiculous! I fully disagree with both verdicts, and will be appealing this whole Biden Directed Witch Hunt focused on me and the Republican Party,” Trump wrote on Truth Social. “Our Legal System is out of control, and being used as a Political Weapon.”

“They have taken away all First Amendment Rights,” he added. “THIS IS NOT AMERICA!”

THANKS BIDEN

Andy the Grasshopper, Friday, 26 January 2024 23:47 (two years ago)

He'll raise money off this but will he raise $83M?

default damager (lukas), Friday, 26 January 2024 23:58 (two years ago)

($83M more than he would have raised otherwise, I mean)
