Judge Engoron just tore into Trump, accusing him of having potentially violated the gag order again with comments he made outside the courtroom. Judge said he is under the impression Trump again disparaged his law clerk. Trump lawyer Chris Kise argued Trump was referring to Cohen

Here is what Trump said: "it would have been fair at least...because no negative jury would vote against me. But this judge will, because this judge is a very partisan judge with a person who's very partisan sitting alongside… perhaps even much more partisan than he is.”

The judge said: "I am very protective of my staff, as i should be…I don’t want anybody killed." After Kise claimed Trump was referring to Cohen, Judge Engoron said he would take the matter under advisement.

More Engoron: "I stated the last time that any future violations would be severely punished.
Why should there not be severe sanctions for this blatant, dangerous disobeyal of a court order?"

The judge is now closing the courtroom with Trump and lawyers still in there.

Trump just exited the courtroom. He refused to say what happened during the conference.

He denied that his earlier comment was about the clerk but he refused to answer multiple questions about who he was referring to.

he had to be referring to Engoron's law clerk, because Cohen isn't "sitting alongside" the judge. So either Engoron is making empty threats or Trump has to be jailed.

In terms of 'empty threats,' the worst thing Engoron could have done would have been to simply throw him in the slammer immediately. Letting him hang himself on his own rope is a much better approach and if Kise tries to file an appeal or complain the next level up goes "Yeah, and how many times was he explicitly instructed about this, and how many ways did you try and skate?"

iirc, one of the early stories about Trump's first statements attacking the clerk mentioned that during some of the more routine and preliminary court proceedings the clerk presided rather than the judge. my sense is that Trump is especially outraged by having a 'little nobody' kind of person in charge of any aspect of the case and treating him like any defendent. it afflicts his rich kid, spoiled, ex-presidential ego because such underlings should only appear in the role of doing his bidding and getting out of his way. I don't know if they are, but if the clerk is also a POC, that outrage would apply x10.

Good question frogbs. Of course, I can't recall very many times that a defendant had been head of state and therefore (theoretically) in charge of the entire government?

(Not defending this repugnant worthless ass, of course. Just saying that it's just a pretty novel situation.)
