(a) A member of the Republican Leadership shall step aside if indicted for a felony for which a sentence of two or more years imprisonment may be imposed.

The GOP would have to change their own house rules to specifically allow someone indicted for a felony to serve, which scans terribly, which means they'd totally do it for Trump.

Even as they wrote that they knew it was nonsense and that no court is going to accept that argument. The question of whether there was any legitimacy to Trump's claims of election fraud has already been litigated and disposed of when he lost more than 60 court cases attempting to establish those claims and did not win once. That puts his efforts on January 6 far outside of any official duties and places his actions squarely in the realm of abrogating his oath of office.

also, the fact that his lawyers took his case looks to me like prima facie evidence that their primary interest was billable hours. they should have been urging him to settle from the first day and every day after and when he consistently refused that advice, they should have resigned, not waiting until he ran out of money.
