is it new news that Scott Hall has flipped in the Georgia trial?

vodkaitamin effrtvescent (calzino), Monday, 2 October 2023 14:34 (two years ago)

Yeah, that's awesome. I bet he won't be the last.

Meanwhile:

Trump isn’t getting a jury trial in his $250m civil fraud suit brought against him by New York AG James because one of his lawyers overlooked submitting the routine request/checking boxes on the form, per two people familiar https://t.co/7zvUfytiEr

Lol, apparently the prosecution leads with an Eric deposition, where he refuses to take responsibility. Then DJTJ, who does the same. Then Donald, who throws Weisselberg under the bus. It's a shame this isn't on TV, because I have a hunch there are going to be lots of awesome deposition clips of Trump and his two squirming scions.

Josh in Chicago, Monday, 2 October 2023 14:49 (two years ago)

Missing a request for a jury trial is pretty much per se malpractice.

il lavoro mi rovina la giornata (PBKR), Monday, 2 October 2023 16:39 (two years ago)

forgetting who the defendant is in this case, is a jury trial usually advantageous for the defence in a civil case?

𝔠𝔞𝔢𝔨 (caek), Monday, 2 October 2023 16:44 (two years ago)

I am not a lawyer, but in this case the judge gets to decide punishment (right?), and he's kind of tipped his hand a little by already establishing guilt. Also, there's no way to get, say, a deadlocked judge.

Josh in Chicago, Monday, 2 October 2023 16:47 (two years ago)

could swing either way I'd think--a jury sometimes hands down a huge $$ judgement that a judge probably wouldn't, but also a judge is less likely to be swayed by your bullshit if you're obviously guilty.

Beyond Goo and Evol (President Keyes), Monday, 2 October 2023 16:48 (two years ago)

I am just presuming Trump would like a shot at getting some of his ppl on a jury. Judge apparently isn't one.

il lavoro mi rovina la giornata (PBKR), Monday, 2 October 2023 16:48 (two years ago)

i guess it makes sense that the verdict of a judge would be more ... moderate?

𝔠𝔞𝔢𝔨 (caek), Monday, 2 October 2023 17:11 (two years ago)

when you are having a bench trial, best thing you can do is slag off the judge and call the AG "racist" outside the court - every little bit helps!

vodkaitamin effrtvescent (calzino), Monday, 2 October 2023 17:18 (two years ago)

xpost You mean the same judge that already ordered the entire organization potentially dissolved?

Josh in Chicago, Monday, 2 October 2023 17:18 (two years ago)

Does that mean a likely appeal or retrial?

what you say is true but by no means (lukas), Monday, 2 October 2023 17:19 (two years ago)

If I had to vaguely guess, besides being that's the only way he thinks, some part of him/the lawyers might be hoping for a 'see if we rile them up they'll act badly in response and then we can claim they really are biased.' But this does not strike me as very sound.

Neither. It's a civil trial, not criminal, so it has no effect on the outcome (no right to effective counsel in a civil trial). But theoretically Trump might have a civil cause of action against the attorney for malpractice.

"forgetting who the defendant is in this case"

Reportedly Trump and his kids are supposed to take the stand, but I don't see that happening.

Josh in Chicago, Monday, 2 October 2023 17:29 (two years ago)

do we actually know that the lawyer forgot to do this and that they wanted a jury trial?

I'm honestly surprised Trump isn't representing himself.

Josh in Chicago, Monday, 2 October 2023 17:36 (two years ago)

maybe the lawyer did it on purpose

out-of-print LaserDisc edition (sleeve), Monday, 2 October 2023 17:37 (two years ago)

I heard that he definitely wouldn't have wanted a bench trial in this case, or wouldn't have been advised to get one if was getting proper legal advise, so I guess it must have been a fuckup.

Josh in Chicago, Monday, 2 October 2023 17:46 (two years ago)

so how does the strategy work exactly, where you call the judge deranged and the case a scam?

StanM, Monday, 2 October 2023 17:49 (two years ago)

I'm guessing it's the "I've got rubes sending me millions of dollars and a decent shot of being President again, and anyway I'll probably die in a few years so fuck it" strategy

“This is a judge that should be disbarred. This is a judge that should be out of office. This is a judge that some people say could be charged criminally for what he’s doing. He’s interfering with an election and it’s a disgrace.”

— Donald Trump, upon leaving his civil fraud trial in New York City.

StanM, Monday, 2 October 2023 18:48 (two years ago)

his rants about the judge devaluing his properties are irrelevant, the figure isn't a selling price it's what the tax appraisers decide it's value is for their purposes. I don't know fuck all about law but I know a pointless, completely null defense argument when I see one.

the figures they used were absurd but there are a lot of reasons for a gulf between taxable value and likely sale value of a property

most of which, if not nebulous and legally questionable, would mean a swift increase at reassessment

in the article it said that youre supposed to submit a form saying whether you want a jury trial or not and they did not submit the form, however the prosecution did submit the form and asked for a bench trial, so yea seems like a oopsie

Yeah, but it doesn't work retroactively. His argument was, iirc, even if it wasn't worth a lot *then* it is *now*, but whatever value was added came *after* it was overvalued. And then there's flat-out fuckery like saying Trump Tower had three times as much space as was assessed. I believe there was some reporting that as soon as the overestimation of square footage came out, Trump Inc. stopped lying about it.

Josh in Chicago, Monday, 2 October 2023 21:05 (two years ago)

always a good strategy at a bench trial - insulting the presiding judge lol

Throughout the day, defense attorneys also took aim at the judge, making testy assertions such as “I don’t think you’re an expert on accounting standards” and “you owe it to the defendants to listen to this evidence.”

Andy the Grasshopper, Monday, 2 October 2023 21:19 (two years ago)

but you see, I signed next to the statement that the square footage magically tripled so I made it so

lol... I've heard it's not even a dedicated form - It's literally a "jury trial" box that wasn't checked on another form!
