i'm hesitant to sound like a defender of u.s. legal system and this is really the wrong case for it anyway, but there are a lot more allowances for defendants to do things in trials because they do not carry the burden of proof.

honestly reading articles like this raises my blood pressure because it doesn't explain the full context of the ruling, and most journalists understand this stuff very poorly to begin with. i can imagine even a more decent judge than this one saying that if there is evidence presented that one of the victims did commit arson, you can refer to them as an arsonist in argument or questioning. they do not need to be convicted of arson. often the victim's behavior is relevant in a self defense case and not much is required to be able to introduce it.

fyi there are special rules in sexual assault trials that do not allow negative character evidence to be used against an alleged sexual assault victim
