Politico is off base. As I never tired of pointing out a year ago, "high crimes and misdemeanors" has nothing to do with whether a president has broken a specific law and the trial in the Senate is entirely divorced from US courts and court precedent or rulings. It's basically a trial on whether the president has used the unique powers inherent in the highest office to do great harm to the nation. The First Amendment doesn't apply, not even a tiny bit.

I see they're hypothesizing about criminal charges after he leaves office. In that case, I'll believe that when I see it. He won't be charged with incitement to riot by the Justice Department unless he dives even deeper into the shit than he already has and now that he can't tweet, his diving board is gone.

There's always the pistol on Fifth Avenue.

If he incites riots in dozens of state capitols he might find himself facing criminal charges regardless of the view of the justice dept.

Charging Trump with being a party to seditious conspiracy eliminates any First Amendment arguments that he was merely making a speech to a public gathering or expressing his opinion that the election results were tainted by fraud. I tried to cool her down (a lot of this was way ott)...and then when I got off the phone I heard the voicemails these fucking maniacs are leaving with congresspeople...ugh
