Per my post a little upthread:

A person who currently advises Donald Trump tells me: “It’s all hit him since yesterday: ‘You may have legal exposure from yesterday. You definitely have legal exposure from other things. You have less than two weeks to remain ensconced in here with executive privilege.’”

Would be willing to bet the source is Cipollone or someone who works in his office.

Ned Raggett, Friday, 8 January 2021 01:52 (three years ago) link

they really think Trump's gonna stop them all from going to jail.

But he can, though! A blanket pardon for everyone involved in the Capitol invasion is entirely possible.

“It’s all hit him since yesterday: ‘You may have legal exposure from yesterday. You definitely have legal exposure from other things. You have less than two weeks to remain ensconced in here with executive privilege.’”

And this very realization is what will make him especially dangerous until he's removed from office. His first inclinations will probably be illegal and may fail to be carried out if he gives illegal orders, but he still has legal options to cause huge chaos and he may well try, since this has been his go-to move for decades.

yes, but be assured that if he happens to do something again, lindsey graham may have to start thinking about the 25th

Donald Trump was annoyed by the violent siege on the Capitol Wednesday — which left several dead — because it looked “low class,” according to his adviser. “He doesn’t like low class things.”

The adviser confirmed that he was watching television coverage of the siege enthusiastically, but noted that the sight of his own supporters forming a violent mob and destroying property and lives offended him on aesthetic grounds.

what is having 'enough' Cabinet members? is there an actual defined threshold anywhere of how many Cabinet members have to be present/sign off?

I didn't see anything suggesting that in the actual text of section 4 of the 25th Amendment

Looking for Cape Penis house (Neanderthal), Friday, 8 January 2021 02:06 (three years ago) link

if the House votes to impeach can he still hand down blanket pardons on everyone including himself?

Yes. Impeachment is pretty much the one thing he can't pardon himself from but until the Senate votes to convict he can pardon away.

Devos resigns. From a friend:

"Cabinet members who choose to leave at this time rather than stay to do the duty of enacting the 25th are just showing what we always knew about them-they are selfish assholes out for their own gain. Devos is the only one who gained by departing now. She thinks she can claim the moral high ground by resigning, but make no mistake about it, this monster has no morals."

howls of non-specificity (sleeve), Friday, 8 January 2021 02:32 (three years ago) link

yeah, it's cowardly

Karl Malone, Friday, 8 January 2021 02:40 (three years ago) link

everybody who keeps saying they're resigning so there won't be enough Cabinet members to enact the 25th - there is nothing in Amendment 25 Section 4 that states there is a such thing as "enough Cabinet members". It just states a majority of the principal officers of the Executive departments - it is silent on how empty seats impact that, but one could interpret that if there are empty principal positions in the 15 cabinet departments, that they could either be a) excluded from the vote, or b) the acting replacement could vote in their stead. Since I doubt it's been tested, I can imagine a legal challenge could occur for that reason.

The other downside to 25th amendment is that if the President challenges the invocation and says he's capable of leading, the same people who wrote the original letter have to send a new one, and then Congress has to decide whether to dismiss the President with a 2/3rds vote in BOTH houses. So that's a harsher standard than impeachment, which only requires 2/3rds vote in the Senate.

Looking for Cape Penis house (Neanderthal), Friday, 8 January 2021 02:43 (three years ago) link

theyre resigning so they wont have to vote

lag∞n, Friday, 8 January 2021 02:45 (three years ago) link

^^ this, sorry for not being clear

howls of non-specificity (sleeve), Friday, 8 January 2021 02:46 (three years ago) link

gotcha - well yeah that goes without saying.

tbh i don't even get how it would work. The Veep takes powers immediately, but the President gets them back if he disputes it with his own letter, unless the original complainant resubmits the claim within 4 days.

so during those 4 days after the Prez has sent the letter, do the powers go back to the Prez now, or stay with the VP? What about the 21 day 'trial' period, are powers with the VP and only go back to the Prez after the trial, or vice versa?

just impeach the fucker. we have experience with that (except for conviction)

Looking for Cape Penis house (Neanderthal), Friday, 8 January 2021 02:49 (three years ago) link

If pence doesn’t want the 25th it doesn’t matter what they do. It’s never going to be the 25th.

There had been plenty of warnings. Plenty of time to prepare. Plenty of money to do it. But twice the Capitol Police turned down offers of assistance - once three days before the pro-Trump riot at the Capitol and again as the mob descended on the building. https://t.co/WbCrkhN5xd
