Rudy, at one point, accidentally suggests a FAR MORE LENIENT TEST FAVORING THE STATE because he doesn't understand what's going on. The judge, who is honest, corrects him and gently redirects him to the general vicinity of what he should be talking about.

“If I conclude that rational basis applies, why don’t they satisfy that standard?”

Rudy: “how is this rational?”

That isn’t the answer Rudy.

xps Can't Shelton's nomination be put forward again once Grassley and Rick Scott return from quarantine? Then McConnell could change his vote back to yes and it would be 50-50 with Pence as tiebreaker. Or is there not enough time?

Dan S, Tuesday, 17 November 2020 23:19 (five years ago)

Sorry last one

Rudy: how is it "RATIONAL" to have different standards?

Jesus this is like a bad Death Wish remake where a feeble old man is getting beaten up by hoodlums

Xxxpost Doesn't this suggest that the certifying is going to happen regardless?

A county board that fails to canvass within 14 days after the election must give all of its documentation to the Secretary of State's office and Board of State Canvassers, which then has 10 days to complete the work and canvass and certify the results, according to the board’s canvassing manual.

Thanks Neanderthal, was just trying to find out more about what happens next with that.

Yeah from the articles I read, it's another punt. A temporary "win" that really does nothing but delay inevitable.

Also WI finished their canvass without issue...woohoo!

there were another 2755 votes found to be not uploaded in Fayette County GA that shifted the vote slightly in Trump's direction, but Biden is still winning by ~13,000, and most of the recount has been completed now

Dan S, Tuesday, 17 November 2020 23:35 (five years ago)

Yeah it was never going to change the victory. However, that error in that county is abnormally large and should be scrutinized. Someone should lose their job over it.

Being cheap is expensive (snoball), Tuesday, 17 November 2020 23:43 (five years ago)

We're never going to have a normal election again, will we?

Btw, Georgia found other instances of vote counts that weren't uploaded from memory card. We're now talking like between 5,000 -7,500

Only netted Trump about a thousand more votes but... optically, that isn't good. It does helpfully illustrate why Trump has no chance though.

it sounds like Judge Brann is being too indulgent, but maybe he's just wanting them to know that their insane concerns are being heard before he dismisses the case.

the quotes from Aronchick have been otm. this has to end somewhere

Dan S, Tuesday, 17 November 2020 23:48 (five years ago)

i think it's the judge going thru the motions of assuming Rudy/the campaign as rational actors (which is how we got into this mess in the first place) so they can dismiss, yes.

Chuck Todd stating Trump refusing to concede after Georgia recount would result in a Constitutional crisis. Even though "conceding" is just a dumb formality so it quite literally wouldn't be a constitutional crisis

white flight, the electoral strategy

from what I can see though, the Board of State Canvassers is also split 2-2 Democratic/Republican?

Other than it being absolutely petty and batshit, like most of his firings, can anyone tell me why people on Twitter seem to be exceptionally worried about the firing of Krebs?

soaring skrrrtpeggios (jon /via/ chi 2.0), Wednesday, 18 November 2020 00:29 (five years ago)

I guess because he is saying the election was not rigged, and he is in a position to know.

this was an interesting article about him yesterday:

I've never understood why the US has such a damn long transition period. In most countries, the old administration is out within a couple of weeks, sometimes within a couple of days

Zelda Zonk, Wednesday, 18 November 2020 00:45 (five years ago)

I think it's more alarming to the GOP, who are trying to appease their dictator-on-training-wheels, even as he continues to throw more gasoline on the fire.

Obviously there's concern any time a President continually fires people who stand up to him and replace him with loyalists, but I suspect us on the left are numb to it by now.

GOP Senators are now probably holding an emergency meaning to try and figure out a way to wag their finger at Trump as mildly as possible to avoid getting death threats.

Lover of Nixon (or LON for short) (Neanderthal), Wednesday, 18 November 2020 00:46 (five years ago)

Re: Michigan, I mean, I presume other counties have similar make-up and didn't deadlock. But...

It is unclear what would happen if the state board reaches the same partisan deadlock. Michigan Secretary of State Jocelyn Benson, a Democrat, suggested in a statement Tuesday night that she could use her powers overseeing the statewide Bureau of Election to get the results from Wayne County certified.

“In similar circumstances in the past, state canvassers have appointed the Bureau of Elections to carry out the processes of canvassing the vote and voter totals,” Benson said. “The Bureau stands ready to fulfill this duty and we expect this will address clerical errors and improve the quality of the canvass overall.”

Lover of Nixon (or LON for short) (Neanderthal), Wednesday, 18 November 2020 00:57 (five years ago)

Follow up to my question ("so are the Republicans just going to do this every election from now on?"), does that mean the Democrats are also going to have to do this shit from now on? The 2000 election, for example, could have *easily* gone to Gore if they went full dick-mode, like these assholes are doing.

Josh in Chicago, Wednesday, 18 November 2020 00:59 (five years ago)
