i dunno, I mean for sure, but for the amount the R.'s complain about voting irregularities and stuff, which signals cheating, etc. you would think they could look up how to file an appeal. dude has been member of the MI bar since 87. but if their filings are this incompetent, it makes them look way worse

Thanks to TS Eta, I had my first conversation with a dumb MAGA-ite this morning. My upstairs neighbor, the alcoholic and emphysemic with the Trump flag still flapping, said hello this morning. We bantered in Spanish about our experiences with last night's incredible rain.

"My wife almost told me to take down the flag because she was afraid it would fly away," he said. "But I'm keeping it up as long as I can."

"Uh huh."

"Not until we settle this fraud."

"Did you vote?"

"Stood in line for an hour two weeks ago." He beamed like a guy who found a fresh pack of Schlitz next to his toilet.

"If fraud happened, why wouldn't we discount the House and Senate races? They're on the same ballot, you might remember."

He gave me the abject, stupefied look of a guy who wants to think of a comeback but can't. I said good morning and walked away.

Trump's lawyer is clearly not a dummy, he has a strong background. My guess is they slapped it together very quickly on low sleep, and it was almost certainly a lower level associate, paralegal or assistant who actually handled the filing. It's not great of them to have that many deficiencies but it can happen in a stressed/time pressure moment. Having handled a lot of filings, I don't wish the experience on anyone. It's my #1 least favorite part of practice and I usually panic for about 6 hours after I file that something was done wrong.

I once (harmlessly) filed a confidential document on a public docket -- had it been more obviously and meaningfully confidential I probably wouldn't have made the mistake, but it was still a big mistake and led to one of the literal worst weeks of my entire life. Meanwhile, we had a case where a lawyer (on the other side) forgetting to file something under seal basically opened them up to getting sued for hundreds of millions of dollars.
