they were always going to lose this jury trial based on the fact that the jurors are not jurists and are voting with their sense of what the morally right verdict is. but the first amendment is pretty robust, and while there are tensions between privacy and freedom of press i don't believe a case such as this is settled or clear-cut under u.s. law.
the gawker defence id imagine (didn't follow this that closely) is that this is "newsworthy" and about a public figure who has been open about his sex life in the media. but what does "newsworthy" mean? how do you define it legally?
don't really buy that this is problematic for a free press tho, like if on appeal the decision is something like "hey sex tapes of folks shouldn't be published without consent" then that's not really the most egregious restriction on press freedom is it?

i do think the appeal could go gawker's way, if much of what denton says in the post is true (i haven't been following this superclosely so probably much of it has already been discussed here and elsewhere). but stuff like this is just hilariously irrelevant:
Back in 2012, to the largely young and metropolitan audience of Gawker, and to those who found the story through news reports and search engines, the post was not particularly offensive. It was their choice to click on the headline and the play button.
