a remake of The Verdict where that guy is the Paul Newman character but he's playing Big Game Hunter at a Dave & Buster's

they were always going to lose this jury trial based on the fact that the jurors are not jurists and are voting with their sense of what the morally right verdict is. but the first amendment is pretty robust, and while there are tensions between privacy and freedom of press i don't believe a case such as this is settled or clear-cut under u.s. law.

the gawker defence id imagine (didn't follow this that closely) is that this is "newsworthy" and about a public figure who has been open about his sex life in the media. but what does "newsworthy" mean? how do you define it legally?

don't really buy that this is problematic for a free press tho, like if on appeal the decision is something like "hey sex tapes of folks shouldn't be published without consent" then that's not really the most egregious restriction on press freedom is it?

i don't know that i care that much about the free press perspective, just bummed cause gawker is one of my favourite websites and this is the stupidest thing for them to go down for.

Interestingly, Fleshbot (an ex-Gawker property) posted a story about this. (They're currently owned by Mr. Skin, I think.) It included the sentence "Yes, I believe in freedom of speech and freedom of the press, but also believe that Gawker is more clickbait than news."

i do think the appeal could go gawker's way, if much of what denton says in the post is true (i haven't been following this superclosely so probably much of it has already been discussed here and elsewhere). but stuff like this is just hilariously irrelevant:
