If it’s a comedy club, the contract is the person’s going to get on stage and explore comedy however they see that comedy is. And the contract for the audience member is to come and see that, and you don’t get a guarantee it’s going to make you laugh, but the comedian is going to attempt to make you laugh. But if they’re not attempting to do material, and the article made [it seem like Tosh was discussing concepts rather than telling jokes]…A comic should have the freedom to go on stage and say whatever they want. The only control you have is what passes your lips. After, you’re saying “I’ve passed this up to be judged.” Everyone else gets to decide whether it’s funny…all the comics say don’t laugh or leave. Those are your options as an audience member. The bigger discussion for me, is if someone walks into a comedy club and gets a lecture about what’s funny or not funny, has that comedian broken the social contract? That’s the question that I would ask because I don’t have any information about the context he was talking about it. It’s all very confusing. The whole thing, we’re talking about so many issues of what people get away with and what they don’t, and at the end of the day, if you’re going to do material that pushes boundaries, you better be fucking funny and know the purpose of why you’re saying those things.

The supermodel Tweeted, "Daniel Tosh didn't get the memo that it [rape] never was and never will be funny." Immediately, Tosh's army of enraged fans started Tweeting threats at Elson (see the example given at left). Elson took down the Tweet, but added, "Until you have walked in a woman's shoes and have to walk in a world where being sexually harassed is common you may understand my point...The replies I received mostly from young men were vile and only proved my point that rape isn't funny. I agree with both the Jezebel piece and the critique of it; the original piece makes a point using sweeping, reductive language which, for rhetorical purposes, removes valid viewpoints from the discussion before the meat of the argument is even discussed. This may be an attempt to frame the discussion, it may be intentional disagreement, it may be oversight; I view it as context positioning personally and, as such, it doesn't invalidate the argument presented as much as expose the filter through which the viewpoint is coming.

people are approaching this the wrong way when they complain that Tosh wasn't being very funny when he made his rape remark. He shouldn't have said what he said because it was wrong, and it sincerely frightened the woman in question. comedy is not just a tool for the underdog and it isn't an inherently benevolent concept. It's a weapon for the mob and bullies, too.
In other words, (this is turning into a pre-2007 lengthy post), comedy and laughter can be used for sadistic purposes and so to start making this a case of "guys it's not funny!!" is not only to be naive about comedy, but you're only encouraging more cruelty (because now people will find it funny to needle you further).
I think the problem is that some people, especially in comedy circles, don't want to come off as moralizing so they instead make this an aesthetic issue about what is and is not worthy of laughter. Tosh can't just be a jerk and that alone.

So my high school friend who performs as "Tammy Pescatelli" had an interaction with an audience member in Jacksonville, FL the other night; Tammy chided her for sitting in the front row and fucking around on her phone for the whole show, and after some back and forth which included the woman saying, "I'm not actually blonde" and Tammy replying, "No kidding! Who did you think you were fooling," the woman threw a full glass of wine at her head. Luckily she was able to duck, but despite a room full of people willing to make statements, police who were called to the show refused to arrest her. WTF?
