As a follow-up, I also think gay people should be able to get married, but Huckabee's line of reasoning on civil unions falls somewhere between evil and just indefensible (Why is it not okay for a gay couple to have a civil union that allow one to visit their partner in a nursing home but it is okay for a gay couple to navigate around those restrictions via a power of attorney?; That's very thin reasoning if you're worried -- as Huckabee apparently is -- about protecting the "fabric of society" from homosexuals).

Because at least with power of attorney, there's a possibility of having a conservative, traditionalist (i.e. bigoted) judge overturn/overrule a nursing home visit. It gives more hope to maintaining the status quo than a law granting civil unions would; if such things are decided on a case-by-case basis in the courts, then at least some of them will swing in Huckabee's favor.

the 'power of attorney' option can really only provide for family visitation / medical / end of life issues, but doesn't provide for the tax and other shared benefits (spousal health insurance, e.g.) that go along with marriage.

Alfred: There are many different uses for a power of attorney ("POA"). It's my understanding that they're used in this context most often when someone can't act on their own behalf; the POA transfers the right to act to someone who is in a better position to take action and make decisions (e.g., they suffer from dementia and can no longer handle their own financial affairs). But POA's aren't used as "backstage passes" in the way Huckabee implies.
To be fair, this isn't my area of the law. Someone else here may know more.
