right, as i implied, xp, but it's not clear that that is what they're alleging

Aw, Jim. Why?

he claim would seem to be that he stood idly by while witnessing others' discrimination because he had directed them to discriminate

or (as may actually be the allegation) that he 1) directed them to get rid of the employees, and 2) was aware of the harassment that others chose as a means of doing so

gabbneb, Tuesday, 25 November 2008 20:02 (seventeen years ago)

"Despite all the letters, I don't believe she should be treated differently in this situation because she is a judge, whether it's positive or negative," Bright said.

gabbneb, Tuesday, 25 November 2008 20:08 (seventeen years ago)

Dude, gabb, are we talking about the same website, linked above? The claim seems pretty clear to me -- the allegation is that the management group was directed by Spitzer to get rid of black employees, and that when a campaign of intimidation did not induce them to quit, they were summarily fired.

(Also there are direct allegations about his behavior in there: "All of this came after direct confrontation with Bernard Spitzer himself on the building property. He refused to respond to any of us - even to a simple 'good morning Mr. Spitzer.' On one occasion when he saw one of my African American co-workers at the front desk filling in for a concierge who was in the restroom, he went out of his mind yelling, turned real red and stomped off.")

I don't know what distinction you're trying to make -- that he may have called for discriminatory firing but that doesn't mean he was rude about it, or something? Because that would be odd.

nabisco, Tuesday, 25 November 2008 20:08 (seventeen years ago)

none of those are allegations that he personally harassed any of the doormen.

gabbneb, Tuesday, 25 November 2008 20:09 (seventeen years ago)

Good god, gabbneb, my question remains: what the fuck difference does that make in the discussion we're having?

nabisco, Tuesday, 25 November 2008 20:12 (seventeen years ago)

the harassment appears to be the order to clean the toilets with toothbrushes, and the associated comments from management company employees. there's no direct allegation that spitzer ordered or was aware of any of those things in particular, or perhaps even generally.

gabbneb, Tuesday, 25 November 2008 20:13 (seventeen years ago)

you are a mystery sometimes gabb

as a dude (goole), Tuesday, 25 November 2008 20:15 (seventeen years ago)

xpost - Gabbneb you are basically sitting here going "just because he's alleged to have made discriminatory orders and condoned harassment as a tactic to achieve them doesn't mean he was personally rude to anyone's face," which, as arguments go, is simultaneously true, pointless, and batshit insane.

nabisco, Tuesday, 25 November 2008 20:16 (seventeen years ago)

no, that's not what i'm saying

I WILL NEVER ACCUSE A RICH MAN OF LOOKING DOWN UPON THE LOWER CLASSES AGAIN. I AM REALLY SORRY, EVERYONE ON ILX BESIDES GABBNEB, FOR BRINGING THIS THREAD UPON US u_u

the schef (adam schefter ha ha), Tuesday, 25 November 2008 20:24 (seventeen years ago)

The argument is that the substance presented in the allegations is not enough to provide evidence beyond a reasonable doubt that Spitzer order the harrassment or knew it was going on. At worst, the current allegation is that he didn't have enough insight into how shitty his proxy was.

None of this is germane to the original, still funny joke.

Black Seinfeld (HI DERE), Tuesday, 25 November 2008 20:26 (seventeen years ago)

xpost - The best I can figure is that he is saying no one has directly claimed "Spitzer directly instructed me to engage in discriminatory practices and harassment," and that the assertion he did is currently a second-hand "that's what the management said" kind of thing. But I'm not sure what difference that would make to our discussion, or who has argued anything to the contrary.

xpost - yeah, Dan, what's the point of that argument here? This thread has consisted of a joke and approximately zero people saying "oh yeah, I have reviewed the evidence and concluded that he's definitely legally responsible"

nabisco, Tuesday, 25 November 2008 20:29 (seventeen years ago)

my reading of the allegations here is that plaintiffs are alleging that they were subjected to harassment, that one harasser told one harassee that the harassment was a product of spitzer's order to get rid of the harassees (nb: no allegation that spitzer knew of the harassment), and that plaintiffs therefore surmise that spitzer ordered the harassment, citing in support circumstantial evidence suggesting that he didn't like them

note that plaintiffs also allege that they were fired right before they became eligilble for union membership. is that consistent with their argument?

http://www.nydailynews.com/blogs/dailypolitics/2008/11/spitzers-father-due-in-court-s.html

The four men have been receiving assistance from an unlikely source: GOP consultant Roger Stone, who has a bit of a history with both Bernard Spitzer and his son.
Stone said he is providing legal and PR advice to the four men for free. He also insisted that the fact he is helping them has nothing to do with any animosity he might harbor for the Spitzers.

lol

gabbneb, Tuesday, 25 November 2008 20:31 (seventeen years ago)

yeah ok, my reading of your argument here is that you have been arguing with approximately nobody

how do you even get laid with this kind of attitude, gabbneb

the schef (adam schefter ha ha), Tuesday, 25 November 2008 20:36 (seventeen years ago)

no, i'm arguing with you, because you are suggesting that i'm saying the dude's fine as long as he isn't personally rude to anyone, while i am suggesting that even accepting the plaintiffs' allegations as true, there does not appear (from the reports) to be solid evidence that spitzer ordered anything other than firing these guys for reasons that can only be guessed at

http://www.nydailynews.com/blogs/dailypolitics/2008/04/stone-redux.html

total, utter, ridiculous, left-wing fabrication

the schef (adam schefter ha ha), Tuesday, 25 November 2008 20:40 (seventeen years ago)

even accepting the plaintiffs' allegations as true, there does not appear (from the reports) to be solid evidence that spitzer ordered anything other than firing these guys for reasons that can only be guessed at

Explain what subtlety I am missing here: one of the plaintiffs' allegations is specifically that Spitzer ordered their firing based on race! The fact that it's not very concretely supported does not keep it from being an allegation

nabisco, Tuesday, 25 November 2008 20:41 (seventeen years ago)

if kerm can get the whole o.g. fanta girls thread deleted because of a mod complain can i get everything from the revive down to this post wiped from my memory?

one of the plaintiffs' allegations is specifically that Spitzer ordered their firing based on race

that's the charge. the only allegation is that one of the other guys said he ordered their firing, and used a racial epithet in the process.

there's a difference between "omg lawsuit may not be well supported with concrete evidence" and omg lawsuit is possibly based upon a genuine misunderstanding of someone's behavior, combined with an attempt to dig into a deep pocket, propelled along by combatants in an undernews war between powerful political and financial interests

gabbneb, Tuesday, 25 November 2008 20:53 (seventeen years ago)

I don't care if you're white black a bitch or a fucking bum off of the streets. If you rap about shooting people, smoking blunts, wearing timbs, drinking hennessy, and whatever else, I'll buy your music. If you rap about your girl, but don't call her a bitch, fuck you. If you rap about the economy and how its hurts migrant workers, fuck you. If you rap about your rap telekenisis or some equally retarded nerd shit, fuck you. That basically how I break it down to an extent.
