Q: What damages are available to an employee claiming constructive dismissal?
A: The compensation awarded for constructive dismissal is the same as that for unfair dismissal and an employee must have at least one year’s service in order to bring a claim. If the employee succeeds in his claim, he will be awarded a basic award (equivalent to a statutory redundancy payment) plus a compensatory award which is based upon his losses. The amount of the compensatory award will normally depend upon the employee’s salary and the length of time that he is out of work, subject to the employee’s duty to mitigate his loss by finding alternative employment. The statutory cap on the compensatory award is currently £60,600.

Kevin Keegan has been awarded £2m plus interest after an independent arbitration panel found that he was constructively dismissed by Newcastle United in September 2008.
In a judgment which has ramifications for English football, and particularly those clubs which employ a director of football, the panel declared that although it was not spelt out in Keegan's contract, managers have the right to have a final say on transfers.
The former England coach, who left Newcastle after the midfielder Ignacio González was signed on loan, against his will and as a favour to South American agents, had lodged a claim which amounted to £25m – £8.6m for the remainder of his contract and £16.5m for "stigma damages". Keegan said he "has found it and will continue to find it difficult, if not impossible, to obtain work again as a top-flight manager"

I can only think that managers aren't employees as such, but engaged under some variety of providing services. Certainly none of them are pissing about down the EAT for sixty grand, it's all yachts and buckets of diamonds for these guys.

I think there's a cap on the amount of money an employment tribunal can award but there's no limit when it comes to a civil court case for breach of contract.

I think that's right - the £60k cap is in an EAT for unfair dismissal damages, but a court could award more for *for example* someone who was entitled to seven years' notice under contract.

curblishley got £1m compensation for a similar claim at west ham so it does still look cheaper to undermine pardews contract and make him claim
the suggestion at the time was ashley gave the 8yr contract cuz he thought madrid or chelsea would end up buying it out, but it looks much more likely that he was prepared all along to repeat the keegan process if and when he needed rid

Would've liked to maintain close-season form as we begin next season (and obviously that's a possibility regardless of the fixture list) but tbh I don't think being concerned about a relegation threatened team having a brutal opening run qualifies as boo-hooing.
