assumed the cps had incontrovertible video/audio of the incident to take it to court
they didn't, so one of the best criminal silks in london and probably a dozen other lawyers get to spend several months finding the slightest sliver of doubt and acquittal is inevitable

I've read the judgment now and it's far from exculpatory in its way. It emphasises how strong the crown case was, even while ultimately deciding the other way. It even declines to endorse the contention that our man is not a racist, which reads kind of weirdly when normally that's the first thing everyone accepts. It makes clear that the standard of proof is the key thing here - unlike with Suarez, where balance-of-probabilities meant the panel had to pick one or the other to believe, and plumped (entirely understandably) for Evra; here the judge more-or-less accepted what everyone had to say, and could only conclude that there was still a reasonable doubt. Which tbf has got to be the right result, because of the key bit being obscured and nobody directly saying what it was.
I guess it's still open to the FA to charge him to the Suarez standard of proof, but I'm assuming that won't happen now.

There is then the evidence of the lip readers. Both the lip reader instructed by the prosecution, Susan Whitewood, and the lip reader instructed by the defence, Laraine Callow, are clearly experts in their field. Nobody doubted their expertise. Helpfully they met together before the hearing and prepared a joint expert report. I can summarise the position, I hope not over-simply, in this way. Ms Whitewood is of the opinion that the words spoken by John Terry are “Yeah and I [obstruction] you/ya fucking black cunt (pause) fucking knobhead”. Ms Callow is of the same opinion. However both experts agree that there is the possibility that they are mistaken and in particular that “you/ya” may be “a” or indeed a number of other similar sounds. It is common ground that a lip reader is unable to comment on “tone of voice” or how words are said. In this context the experts cannot say whether the words observed were in a question form. Both experts agreed on the limitations of lip reading spelt out in Appendix 2 of Laraine Callow’s report, with “extremely minor differences”.

Valencia sources have told Sky Sports they have been offered Chelsea captain John Terry by an agent.
Reports claim that Terry could be heading to La Mestalla as early as January.
A Spanish agent Francois Gallardo claims he is helping with the deal and told Radio Intereconomia: "Valencia are negotiating, and I am involved in person, with the signing in the winter transfer market.
"The offer is on his table. The player is out of contract in June [sic - contract is until 2014] and will not renew there for several reasons at Chelsea and he wants to come to Spain.
"Terry has problems. They are insulting him and he is not taking it any more. He asked to leave, not us.
"It's real. This has been going on for 15 days and two meetings have already took place. The deal is already on his table - a year and a half plus one.
"I think he will accept."
