are there legal issues doing it one way or the other?

highly theoretical, of course. (tehresa), Tuesday, 30 September 2008 04:33 (fifteen years ago) link

well....let me think about it. i know you get an "easier" path if you go the K1 plus you get to be a citizen after 3 years instead of 5 but I think if you go get married tomorrow they might put you through a little pain but there really nothing they can do about. you can just be all "OMG were so in love we had to be married right now!!!!!!"

let me research it a little more. i know we were trying to decide between the two.

also dont forget matesupover.com which is a bb for people moving to the states mostly on K1 visas

Bright Future (sunny successor), Tuesday, 30 September 2008 04:47 (fifteen years ago) link

oh shit i heard a this american life about someone who was married but her husband died before they finished processing the visa but it was because the gov't people kept postponing the interview or something, and then they tried to deport her. it was super messed up :(

AND OMG I FORGOT TO TELL U GUYS I GOT MY RAY CAESAR ART BOOK TODAY!!!!!!!!!!!!!!!!!!!!

re the marriage thing: it's fairly complicated. legally, we can't get married while i'm here on this work visa, because it's considered fraud to come here on a J-1 with the intention to marry or immigrate. so we would have to fabricate a story about meeting over here or something. plus, i don't think i could work for awhile after we got married. i dunno, it's all very confusing. but we can't really plan anything till closer to the end of my visa, since the laws are always changing. it's v v stressful and i'm constantly worrying about it :/

even if you go via K1 visa you wont be able to work for a good 4-5 months once you get to USA.

And, yeah, if you got married now youd just have to be all 'oh hey we didnt realize we'd fall in love , dudes!"

Bright Future (sunny successor), Tuesday, 30 September 2008 15:19 (fifteen years ago) link

anyway, dont stress about it. its all pretty easy in the end.

Bright Future (sunny successor), Tuesday, 30 September 2008 15:20 (fifteen years ago) link

oh ALSO i wanted to tell you to start documenting your love. Youre literally going to have to prove it, so photos of you together, with his family, photos that somehow show you over time to prove youve been physically together for a while. At some point they will ask for written affidavits from friends and family members explaining how you two met, how the person writing met you, their impressions of you when you are together. I think they ask for three of these.

oh and ultimate trump card - get pregnant. DHS likes it when you make americans.

well, i kept every single piece of written correspondence from the 15 months we knew each other before i came here, plus letters and stuff he sent me. and we already have lots of photos. BUT on the visa journey website i read, lots of nzers have said that when they've brought all the relationship proof stuff to the interview, the interviewer hasn't even wanted to see it. i think there isn't much dodginess going on when it comes to K-1 visas for kiwis, so they don't need to much evidence, it's more just all the paperwork and red tape.

xpost to john justen: kozyndan is AWESOME. we have a print of the wave of rabbits. it's not 'art', exactly, but i will send you a freebie copy of our chapbook if we do a second edition (which is looking likely at this stage).

Ugh, visa is now top of my list of things that need to be sorted. (actually I think student loans are as I need those before they will give me a visa) All complicated by the fact I need working privileges tacked on to it.

When me and sgs were sorting out her visa to stay in the UK we compiled loads of stuff to prove our relationship - photos, air tickets, letters, you name it - and they didn't look at a single document. It was purely the compulsory residency documents (in our case) that they cared about.

Mark C, Tuesday, 30 September 2008 16:33 (fifteen years ago) link

You still should take pics of yourselves and save love letters for the grandkids.

Peanuts taste like peanut butter (Susan), Tuesday, 30 September 2008 21:49 (fifteen years ago) link

Ed, do you not have working privileges on a student visa? CMU should be able to help with directing you, they must have office in London or something.

You can get working privileges but the default is not to have them and if you get them the restriction is to campus work only limited to 20 hrs a week, it is harder to get more general working rights. Of course they will help it is just more difficult.

Tza, was she beating things up with an umbrella-ella?

Sara, don't let school kill you. We would miss you.

she was at the show i saw. she was ushered in and out just as the lights dropped/came up each time. lots of girls were screamy. there were paparazzi. she seriously did not crack a smile the whole time. poss too drugged to do so? i wish she'd done something more exciting!!

highly theoretical, of course. (tehresa), Wednesday, 1 October 2008 13:07 (fifteen years ago) link

I can imagine such a fuss following you everywhere you went would make you unlikely to smile. Especially if you're borderline crazy. (Speaking as someone who is borderline crazy.)

no i mean, she was unresponsive to the show when sitting in the dark with no one bothering her and nothing to do but watch/enjoy it.

in the heights: very high energy, funny, etc.

side note: i met a dude at karaoke last summer who told me he was a dancer in in the heights and i thought he was full of shit (this may also be because i congratulated him on the tony and he seemed confused, and also because he told me i reminded him of his wife... but he had an unmarried, identical twin brother i should meet). turns out he wasn't - he is like, dance captain! lol. he was good!

highly theoretical, of course. (tehresa), Wednesday, 1 October 2008 13:36 (fifteen years ago) link

oh nm i just looked he is not dance captain but oddly seemed to be featured more prominently than the captain listed...

I had a completely insane dream last night of Sarah Palin entering the debate ring as a figure skater, wowing the crowd in her spangly pink uniform and performing beautiful skating tricks. In my dream she then took a horrible fall on these skates.

I kind of like this dream, as it seems to me the perfect metaphor for what has happened to her over the last month.

That being said, get the hell out of my dreams, Sarah Palin. You're not welcome here.
