Attorney Asks For Mental Competency Evaluation

OLATHE, Kan. -- Teenager Andrew Ellmaker was charged with killing his mental health caseworker in court Tuesday.

Ellmaker's attorney, Joe Dioszeghy, asked for an evaluation to see if his client is competent to stand trial.

"A competency evaluation is basically to determine whether he knows and understands the nature of the proceedings and whether or not he can make and assist in his own defense," Dioszeghy said.

Ellmaker is not taking medications now for schizophrenia and other mental problems, and was not for some time before his arrest -- despite his mother's efforts to keep him on them.

Teri Zenner, 26, was Ellmaker's mental health caseworker. She was killed at the Ellmakers' house during a routine home visit. Zenner's husband and other close friends and relatives were in court.

Someone said that Ellmaker was fanatically enthralled by the band, Insane Clown Posse.

One of ICP's CDs contains 30 tracks of what the band calls "serial killin', mass murderer music."

Ellmaker was wearing one of the group's T-shirts when he was arrested.

Zenner's family said that Ellmaker's mental state isn't terribly important to them.

Two teens with their faces painted like clowns were arrested by West Valley City police last weekend for allegedly trying to kidnap a 5-year-old boy - the second time in recent weeks that members of the so-called Juggalos gang have crossed paths with law enforcement.
On July 29, two suspected Juggalos attacked a Kearns teen outside his home with a knife and a four-bladed replica of a medieval battle ax topped with a spiked ball.
The victim suffered life-threatening injuries, including an 8-inch gash to his neck, and required more than 300 stitches to close his wounds.
The two alleged attackers waived their right this week to a preliminary hearing in 3rd District Court.
Cody Jesse Augustine, of West Jordan, and Scott Tyler Stapley, of Murray, both 21, are each charged with one count of first-degree felony attempted murder. Arraignment is set for Oct. 3 before Judge Judith Atherton.
The attempted child kidnapping occurred Saturday evening near 4000 South and 1500 West, where two teens with faces painted like clowns - half smiling, half frowning - tried pulling a 5-year-old boy to a car. Police said one teen threatened to kill the boy.
The pair finally let go of the victim, who ran to his apartment, where his father called police, according to Capt. Tom McLachlan with West Valley City police.
The two suspects - an 18-year-old and a 15-year-old - were found in the area with paint still on their faces. Police said they acknowledged involvement in the incident, but offered no explanation. The 18-year-old was booked into Salt Lake County Jail on suspicion of an attempted kidnapping, a potential felony, and marijuana possession, a misdemeanor.
McLachlan said it's difficult to define all Juggalos as gang members based on actions from a minor subset, adding that he has been told that Juggalos' music generally encourages them to examine their lives and better themselves.
But he said West Valley's selective enforcement unit is "very aware" of the Juggalos - both those who cause problems and those who do not.
McLachlan said members usually do not walk around with painted faces unless they are involved in some sort of group activity or going to a concert. Some, he said, have tattoos, wear jewelry or sport bumper stickers portraying a little red man running with a hatchet in hand.

Who are the Juggalos?
Juggalos are enthusiasts of the rap group Insane Clown Posse, but police say it can be difficult to define the movement. The Salt Lake Metro Gang Unit officially calls the group a gang and estimates there are as many as 4,000 Juggalos in Utah. Capt. Tom McLachlan with West Valley City police clarified that only about 15 percent of the group are involved in gang activity.

I was flipping through a local weekly as I ate my dinner tonight, and I learned, for the very first time, what a Juggalo is. I don't know if I can find the right words to explain this, but I feel as if the general quality of my life has improved immeasurably now that I'm armed with this valuable information.

Every time I see an article on Juggalos or ICP (ie one recently in Wired), I think, "how did everyone not know about this since 1997?" I am glad these articles still have an audience to teach, to persuade, and to delight.

I think it’s a Midwestern-flavored record. It doesn’t use a whole lot of California-style slang to it, West Coast-style words or slang, even when we’re telling a story or something. I think about this a lot. Even when we’re telling a story talking about we’re jumping a car, or crossing the front lawn, those things matter, because if you live in New York you don’t have a front lawn. So if you’re telling your stories in your rap like, “I ran across the front lawn,” or, “I kicked his ass on the front lawn,” little things like that, “I pulled up in a driveway,” just words you use and shit, it just is Midwest.
