I think the difficulty in both cases was trying to find someone with enough individual responsibility to prosecute. That's not easy to do when you have a string of incompetent or dodgy decisions by a large number of people.

There's an element of that too, of course, but it's not much easier going after a rail company for corporate manslaughter after an avoidable crash, etc. Health and Safety regs are often used there too.
