b) beyond that, hate crime laws are unnecessary bcz judges & juries already have all the tools they need -- including intelligence & insight -- to determine whether an assault or vandalism or harrassment or murder has that extra tasty frisson of racism or homophobia, and punish it accordingly.

I disagree with this not for GFF's reasons, but just because it's patently false: judges and juries can't mete out extra punishment based on "that extra tasty frisson" unless it's stipulated in the law that they can, that this particular frisson is a legitimate aggravating factor. (If the maximum sentence for a crime is 5 years, judges don't usually have the discretion to hand down 10 based on any outside factor that's not put in their purview by the legislature!)

Posting way, way back to Tracer -- the reason I'm talking about these things in terms of prosecutorial misuse is that the kinds of situations you've outlined here aren't just fuzzy applications, they are (to my mind) completely outside the actual letter of the laws, which would seem to require that identity be the primary motivation for the action: obviously I don't disagree with you in the least that inferring this from any crime in which a racial epithet is uttered is completely fucked up, and such misuse could well outweigh any benefits the laws are designed to have.

It is my lack of legal knowledge justification. I find it pretty effective though! I mean it may be pretty obivious but I think most the knee-jerk against hate-crime legislations can be defused if you get people to sign on for "the system meant to protect us all equally doesn't do so."

What I'm about to say couldn't be any more off topic, but in light of some recent decisions by the U.S. Supreme Court, there is some question whether a judge is permitted to increase a sentence for a crime based upon the bias motivation for that crime, unless the motivation was first submitted to the jury and the jury made a finding on that bias motivation.
