really surprised my post up there turned out to be so controversial (and "eppy", whoever you are, suck a dick. dumbass? seriously? based on that post? what the fuck). it was really a reaction to Tracer, who seemed to be saying:

a) hate crime laws have the net effect of putting more minority defendants in jail for long. (this is completely believable)

b) beyond that, hate crime laws are unnecessary bcz judges & juries already have all the tools they need -- including intelligence & insight -- to determine whether an assault or vandalism or harrassment or murder has that extra tasty frisson of racism or homophobia, and punish it accordingly.

and i have a problem with statement b! i mean, i don't want to pedantically list off jim crow and twinkie defense and all that, but i'm not so sanguine about the legal system's ability or willingness to find and punish those things, without an "intervention" by legislature saying, yes, these motives are worse, you must consider them.
